Hello everyone, we've encountered a kind of confusing situation. This is very long as I wanted to give you all of the information we have to ensure that you can provide the best response possible.

Our I-130 was approved at the CSC USCIS and we received the NoA 2 E-mail on July 30th. Along with the e-mail that day from the USCIS stating our I-130 had been approved, we received an e-mail regarding Card/Document Production as the subject and that it was returned by the post office as "Undeliverable." We called immediately and were assured that it was most likely an error and that everything was processing as normal and it would be sent to the NVC.

Yesterday, on August 14th, we received the following e-mail :

Your Case Status: Card/ Document Production


On August 14, 2014, the post office returned your document I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN as undeliverable. If you do not contact us at 1-800-375-5283 within 180 days from August 14, 2014, this document will be destroyed and you will need to file a new application with fee

Now, we began to become very concerned because this was the SECOND time we've received this exact same e-mail from USCIS regarding a Card/Document production being returned, and we still had not even gone through the NVC Process. At this point, we decided we would call and find out what was going on.

Of course, the initial customer service representative was clueless and we were escalated to a higher level supervisor to explain to us what was going on and we found out the following information.

On July 15th, 2014 we made a change of address because we moved back to my wife's family's house so we could be a little more financially prepared for the move back to the states when the visa was finished processing (Both of us have been living in Romania since August of 2013, and we only moved to an apartment about 45 minutes away in the city). We had the receipt number and a confirmation e-mail from the USCIS stating that the Change of Address had been completed. The Tier 2 Supervisor explained to us that the USCIS system is unable to change address internationally and therefore the customer service representatives who do them over the phone must find workarounds and make notice of the comments section of the petitioner/beneficiary's residence. We were informed that although ALL of the information was correct, the city and country were completely off. We have lived in Bucharest, Romania and at our current residence, combined, since August of 2013, long before we filed our I-130. He explained that the Customer Service representative who had taken our change of address did not acknowledge the comments that we were both currently living in Romania and therefore put our address with a New York, New York address. Apparently, the e-mail of undeliverable mail was in reference to trying to send us our Approval of I-130 NoA 2, which definately would never have reached our hands since we're living in Romania and no where near New York. Upon instruction of the tier 2 supervisor, i promptly sent a message to the e-mail address he provided me with the receipt number of the change of address and explaining the situation that they had made an error.

Ok, now that you understand the situation, here is my question.

After we received all of these e-mails on August 14th, our case status on the USCIS website was completely blank, no Post-Decision activity or anything. Under Case State it was just blank. So we called the NVC hoping it was there. The NVC recieved our approved I-130 package on August, 13th. I assume that processing will continue as normal, but will the change of address issue the USCIS caused be any delay to us? Upon waking up today on August, 15th, I had 3 e-mails from the USCIS. One was from an actual Immigration Officer with an attachment of a duplicate form of our Approved I-797 Notice of Action. The other two e-mails were from USCIS, and upon logging in to the case status website to see what was going on, it shows our I-130 case back in the Acceptance phase with the following message: Status:

AcceptanceOn August 14, 2014, a duplicate notice was mailed to you regarding a decision on this case, or describing how we will process the case if it is still pending. Please follow any instructions on the notice. Your case is at our CALIFORNIA SERVICE CENTER location. If this I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN is still pending, you will be notified by mail when a decision is made, or if the office needs something from you. If you move and this case is still pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

So, as of current, the NVC has received our approved I-130 package, our hard copy of Notice of Action 2 (Approval) is currently en route to our correct address in Romania, and the USCIS website is showing us in the Acceptance phase again. The Immigration Officer I spoke with last night assured me that this would not cause any delays and that processing would continue as normal at the NVC, but my question is, why is it back to the Acceptance phase at the USCIS if it is with the NVC now? Is this a set back in the fact that the NVC will not begin further processing until the USCIS sends another I-130 package with our updated address or is this just some goofy USCIS error that we're needlessly concerned about? I would call them again, but we cannot afford to spend those kind of cell phone minutes getting scripted answers from the initial customer service, just to get put on a 35-90 minute hold to speak to someone with half of the right answer.

I understand this is long and appreciate you reading it, but I figured knowing the whole story versus bits and pieces could help you provide us with a more accurate response.

7/1/2014 - E-mail of acceptance with Receipt number - NoA 1 (Routed to California Service Center)

07/15/2014 - Change of Address via phone call with USCIS, confirmation via e-mail.

7/30/2014 - I-130 Approved at USCIS - NoA 2 E-mail

08/13/2014 - NVC Received Approved I-130 package from USCIS

08/21/2014 - Case Number and IIN created at NVC

08/25/2014 - Case Number and IIN received via phone call. DS-261 Available and completed online.

8/26/2014 - AoS Fee invoiced and paid online.

8/28/2014 - AoS Invoice status PAID

09/04/2014 - Expedite Request response - Must enter Beneficiary Date of Birth - Re-sent exact e-mail with requested info

09/10/2014 - Expedite Request e-mail received as "Under Review"

09/11/2014 - Expedite Request Approved - Confirmation via e-mail from U.S. Embassy in Bucharest, Romania

09/16/2014 - Embassy Received Case from NVC

09/16/2014 - Received E-mail from Embassy to Schedule our Interview and prepare documents

9/23/2014 - Medical Exam at Regina Maria - Results OK

10/01/2014 - Visa Approved!

10/03/2014 - Received Passport with Visa!

11/2/2104 - PoE Atlanta - Welcome to the US!

11/5/2014 - Paid $165 ELIS Fee

8/1/2016 - I-751 Packet sent in for Removal of Conditions!

8/15/2016 - Notice of Action 1 for I-751 - California Service Center

9/29/2016 - Received Biometrics Appointment

Hey, I've encountered the same problems as you. No worries. I was approved on July 24th. Then, on August 6, I received three USCIS case status notifications, as follow:

1) Post office returned the notice we sent you as undeliverable, please call.....etc.. *BACK TO INITIAL REVIEW)

We got worried and we called USCIS customer service.

hour later....

2) We re-sent the notice to the address we have on file. (CARD/DOCUMENT PRODUCTION)
3) RE-APPROVAL (POST/DECISION ACTIVITY)

We got so worried and called again..it just means that they made a mistake by sending it to the wrong address I believe.

On August 13th, we received 2 new updates:

!) Adress change (BACK TO INITIAL REVIEW)

and later that evening, 6:45pm

2) Shipped to Department of State *POST-DECISION ACTIVITY


it;s just goofy error like you say..They make mistakes..

Wierd though....the problem has to do with TENNESSEE'S post officesss!!!!! Both of our petitioners are from the state of TENNESSEE

Hey! Thanks for responding :) Sorry it took so long to get back VJ to check it out! I hope it's just an error with USCIS (Again) and it doesn't slow us down. I hate that you had issues with them too, but i'm glad to know that everything was worked out for you. We haven't gotten an update past Acceptance on the Case Status yet, but we're thinking it will be ok since it is already at the NVC and they have it.

Yea, I just saw we're both going to be living in Tennessee! Keep me updated on your progress and i'll do the same! :goofy:
