Hi, There,'

I went to my interview for my citizen ship today. Its based on marriage. the IO interviewed me for almost 40 mins. She started the test first and I passed. Then she started N400 and later on went though files we submitted before.

Our situation. below is what she asked but we don't have

1.no joint bank account. (we used to have BOA and CHASE, they all closed us without telling us the reason. I have the rencent letter from chase before they close our account, they sent us letter. I took it with me and IO keeps that)

2. car insuarance under me and my husband name. but registration is under his mom. His mom paid for the car. i explained to her

3. no health insurance(i work part time, my husband work full time but his company will not pay part of the health insurance so we didn't purchase one.) I explained to her.

what we have and showed the same address

1. cable bill under my name

2. gas bill under my husband name

3. electricity shows my husband name

3. joint tax return for past 3 years.

IO ask me to submit history of residence from DMV and also passed 3 years W2. my driver's license address is not my living address and it is a mailbox.

Has anyone meet the same problem? Is there anything serious about my case? The worst case if they didn't approve my case will they take back my green card?

They will not take back your GC. The IO is just trying to make sure that you guys have actually been living together and that you are not trying to circumvent the naturalization process. You DL being a mailbox did not help matters either. I believe if your story checks out you will be granted citizenship.

Sorry to hear that. When I remove condition green card, the atternorny didn't ask these things, then uscis ask it, we gave everything together , it takes a year it get 10 gc due to late document. I am apply under 5 year rule now , hope they don't have too many problem .

My Driver license address is P.O box . My husband addressing 5 years ago and he never changed after he moved. W-2 mine last 2 years showed my home address. But my husband w-2 showed his address when he started his job long time ago. He never changed it because his company always pass the w2 to him at work. It's seems driver license and w-2 address won't help. Will this be a problem? The io need those documents just to make sure we are all work and stated in the same city or anyone have any idea. Thank you

Looks like the issue is with your residential address.

You and your spouse has to be able to show documents that state clearly you both resided in the same house.

Having P.O box address and W-2 being received at different address is an issue but it's not a deal breaker if you have supporting documents.

Did you get a RFE letter? If not wait for it.

In the meantime, my suggestion is to change your address on DL from P.O box to where you live and also if you can get both of your names on utility bills, open joint accounts etc and wait for the RFE letter which can take several weeks.

Once you get the RFE, attach the documents and write a letter clearly stating that you both live together etc.

Anyone please give me an advise on how to send the extra documents.

IO need. 1. rensident/current history of driver's license 2. W-2 for passed 3 years.

Should we just send these helpless documents alone or we should send a letter explain it a little bit?

You should changed your address with DMV before you went to the interview. From my understanding , the DMV wants your physical address not your mailing address. IOs ask for the ID at the interview not only to confirm your identity, because they can do that with your passport or your GC, but also to see your address ! The norm for people is using the physical address on all their mail, some people have pobox because they keep moving or they are having problems receiving mail to their physical address. So, it might be looked suspicious to the IO, and that's why she asked about everything to examine and then decide. What to do now !

-get your history address from the dmv and your w2's.

- you need to write a letter explain your situation and tell them why the address is not matching with your residence address. Make your husband write a letter and explain that as well ,and testify that you have been living together since marriage. Ask your mother in law to write an affidavit and explain that you guys live together and it's a good idea she mentions that she helped you and your husband with the car...... Ask friends for notarized affidavits as well, the more the better, you need make pressure on the IO using the affidavits. When you have 7-8 affidavits testify that you guys live together since marriage , I think it would be hard on the IO not to take that into her consideration!

when you filed for AOS, ROC you needed to proof to uscis that your marriage is a bona fide marriage. however, when you file for citizenship based on 3 years rule there is another requirement for that which is the applicant should be living with his/her US spouse together for the last 3 years, even if the IO is sure about your relation that it's a real marriage but if you guys were not living together the whole time then the IO can't approve your citizenship because you are not qualified under the law, I hope you understood the difference now, remember your entire A-file will be reviewed at the citizenship stage . Since, as you mentioned you didn't have much of evidence on your file, the immigration officer asked for all this proof. people who sent a lot of proofs during AOS , ROC usually they didn't asked to provide proofs or the io would ask for whatever they have @ the interview time.

They won't take your GC & Good luck

day 77-- 06/26/2012-- interview / approved on the spot.

day 86-- 07/05/2012-- Received my GC in the mail.

day 16 -- 04/23/2014 -- Walk-in Bio.

day 197 -- 10/20/2014-- Approval Letter received dated 10/16/2014

day 202 -- 10/25/2014-- GC received
