Ok, so my divorce in 2012 is biting me in the butt for my i-129 papers. I had an easy divorce from my ex with no issues, went to make copies for my application and noticed on one line, the judge restored my name back to my maiden name. and on the front page of the divorce packet it says my maiden name. But I never asked for it to be restored. I never got my name changed on my drivers license, and I even got an ID at the same court house under my married name a year after my divorce. I asked the judge for an official thing requesting that be amended or voided, and he replied today saying it has been too long and I need to file for a name change. That will take months, 350 dollars I dont have, and Ill need to explain to a judge why I want to change my name back to my exes. Or I can get a new passport, new drivers license, and SS card, which will also cost a lot, hold me back for months and ugh.. These are the only two last names I have, my birth certificate, marriage certificate and divorce papers have my maiden name. All my IDs, pay stubs, mortgage, all my bills, are under my married name. What should I do now? Send them in like they are and hope this isnt an issue? Send the first and last page of the divorce papers that have the decree, stamps and signatures, to prove the divorce and hope they dont make a big deal about the last name being my maiden name? Or what? I really cant afford a bunch of ids or a name change. Thanks
And what exactly do they do during the processing process? Background check? Credit check? Contact the courts to make sure my marriage and divorce are legal? Call my work or mortgage company?

Uh....how can the judge change your name? Just because you get divorced does not mean you change your name does it?

If the judge made a mistake....hmm.....that really sucks.

The bottom line is that you have a legal name......the judge cant just randomly change your name.....

I dont know how it works with aliases....but there must be many people with different name on divorce decree and current name.....show USCIS what happened..they will probably reply and tell you what they need if its a problem.

Or just change your name if you want to do that anyway....but if you dont want to change your name, and you never asked to change your name...then the judge screwed up and you would think he should fix it.


And honestly..if you dont have $350.....you are going to find this process tough...it gets a lot more expensive than that unless everything goes perfectly...Im well over $10K in fees and legal costs etc etc....and still waiting on the embassy to issue the K1....close I hope...

I supposed the problem came from not actually getting the divorce done in front of the judge. We agreed on everything so a secretary wrote everything up, had us wign it and had the judge sign it. They are supposed to ask if I wanted to have it changed and I guess someone just assumed. Its annoying. Do you think they will just ask for more information if I send it in like this? Or do you think they will reject my whole app?

10k? Wow, thats the highest Ive heard of. i hope your issues get worked out and hope I dont run into the same. I really dont have a lot of extra money for this.
