My fiance is the USC and he has been previously convicted of a "civil infraction" (non criminal) for "disturbing the peace".

However, this was in relation to a dispute between him and his ex-girlfriend (not fiancé/spouse but they were living together). He was arrested under the charge of domestic violence but the conviction resulted in a civil infraction.

We are about to lodge the I-129F package. Does he need to submit the report with the civil code on it or does this not count as a criminal conviction to do with domestic violence?

Thank you for your help. I'm worried about getting an RFE.

He needs to get certified copies of the arrest record and police reports. Also, he needs to get certified copies of the court record and the final disposition of these cases and any other cases listed on the I-129F. It's important to show this conviction on the I-129F and to follow the directions carefully.
