True - although I know in our Virginia county you have to prove legal status in order to register the child.

Regardless - the OP didn't state they came illegally so hopefully he clarifies and understands this for himself

I'm assuming that they came into the US legally since immigration was satisfied with the paperwork that was provided. The mother is a US citizen and provided her passport as well as birth certs for each child.

I'm going to see about getting them their passports.

Hi, im the son. I claim citizenship by birth abroad. My mother was born in the sates. Ive been here almost 8 years. Went the greencard route first that was bogus. Was told the n-600 route was the best way but that appears to be bogus too. Recently found that i can get a passport with 2 affadavits and proof of that my mother is a citizen. Is that correct? if so i can use that passport to go ahead an get a sn# and forget the n600

I am still confused. How did you enter the US back at the time when your mother dragged you over the border? I don't think she could just get over by showing her US passport, and the fact that you guys are her kids. She needed to either obtain a CRBA + US passport on your and your sister's behalf, or as "tourists" (aka non-immigrant, Canadian citizens). So either she has already claimed you guys to be a US citizen (via N-600, and obtaining a US passport at the time when coming over to the states back in ancient ages), or afterwards. Either way, if she has claimed you guys already a US citizen and you guys have the proof of that you could have gotten a soc. sec. and DL immediately (ok, not DL- that one is age restricted) and could be working your butt off by now paying taxes to Uncle Sam. If she has never claimed you guys formally to be US citizens, she needs to do that and then the N-600 is correct, and you or your mom, or your dad (whoever volunteers) could make an infopass at USCIS and go in and talk to them as somehow that application ended up deep down in the black corner of a drawer. Once that is approved, then you could apply for all sorts of heavenly material your heart wishes to. But first you need to know how you guys entered, and whether your mom ever claimed you a US citizen in the past already. Better not ask us here. Go, have a long chit-chat with your Mom and make her pull out all the documents she has ever kept in her entire life from the point of getting married to your dad. She might come across something that clarify things...

Note: My Mom was a USC, but she never claimed us formally US citizens. Thus, when we moved here, we were on visa for a long, long, looooong time and like you, couldn't enjoy having a crappy paper card (SSN) wrinkled up in our drawer that would've made us be stamped as "welcome local" on our forehead. I'm bringing this up so you see, just because a parent is a US citizen it doesn't automatically makes the abroad born kids to be citizens...it's all business. Mommy/daddy have to apply for it for their kids...I'm amazed US born people don't have to yet claim their citizenship separately from their birth certificate...if the economy worsens that might going to happen just to get some more money into USCIS' pocket. ;)
