Hello VJ'ers, I am new to posting to VJ, but have been reading so many topics since 01/16/2014. I have learned so may great things from this website and I appreciate all the information that has been giving to everyone on here.

Here is my question. I am sure it had been ask before, but I could not find it here any where.

I am an Army veteran and I receive VA benefits and social security. My VA benefits are tax exempt, and the amount of social security I receive is less than the amount you need to make to file taxes.

What can I provide to prove that I do not have to file taxes, when I submit my affidavit of support forour K1 visa?

NOA1 Received January 16 2014

Alien Registration Number changed January 16 2014

Thank you for any information you provide. It only has been 3 months, but this has been a long ride already and I understand we have a long way still to go!!

consulate received hard copy of petition(CEAC website update) July 15 2014

passed medical (took one day fiancee got there at 4:00am finished at 4:30pm) July 22 2014

CFO completed certificate issued (fiancee said people were very nice process very easy) July 30th 2014!!

Interview date scheduled for September 10th 2014!!

Interview approved!!!

Visa issued!! CEAC website September 16 2014!!

Visa received on September 18 2014 yeah!!!

POE September 21 2014!!! Yeeees!!! What a journey!!!!

Wedding day!! October 16 2014!!

My fiancé receive VA benefits every month but he do file taxes. He just filed his 2013 ITR. So when I had my interview I showed his VA info that shows his monthly income and OWCP with his monthly income also and his 2012 ITR.

How do he file taxes?, Taxes are not taking out of my VA benefits nor my social security benefits. There is nothing to file. I will not be receiving any tax refund nor will I owe any taxes, so its a waist of time in my opinion.

So maybe I can just show my benefit letter from the VA and social security? Will that be enough?

It is U.S. Law that every person file a tax return. All monies my fiancé receives is tax free and has to file every year. He pays to file his taxes. He also pays taxes for his properties and cannot collect any money in return. Because his money is tax free. He went to the VA and OWCP they gave him a letter saying his monthly income.

Thank you so much for your info, but I found out what I need to do from some people who was in my situation, they advised me all I have to do is send a letter with my benefit letters showing my monthly income, 6 months of my bank statement showing my direct deposit and a letter from the IRS explaining why I am exempt from filing taxes. The letter can be downloaded from the IRS website!!

Since I am exempt from filing taxes, I don't have to file. I may file if I choose to, but I really don't have to because I am tax exempt and it really will not make a difference if I file or not.

Veterans’ benefits are also excluded from Federal taxable income. The following amounts paid to Veterans or their Families are not taxable:

Education, training, and subsistence allowances.
Disability compensation and pension payments for disabilities paid either to Veterans or their Families.
Grants for homes designed for wheelchair living.
Grants for motor vehicles for Veterans who lose their sight or use of their limbs.
Veterans’ insurance proceeds and dividends paid either to Veterans or their beneficiaries, including the proceeds of a Veteran’s endowment policy paid before death.
Interest on insurance dividends left on deposit with the VA.
Benefits under a dependent-care assistance program.
The death gratuity paid to a survivor of a member of the Armed Forces who died after September 10, 2001.
Payments made under the compensated work therapy program.
Any bonus payment by a state or political subdivision because of service in a combat zone.
