Hi everyone,


I was actually wondering what USCIS called marriage in order to obtain a green card.

Is that illegal to get married cause it will be the only way for you and the person you are in love with to be together in the same country? (in this case, the U.S).

It is all about intent and purpose.

If the primary intent is to marry in order to obtain benefits (such as a green card), that places the importance and purpose on the benefits (such as the green card) and not the marriage. The marriage then just serves as the means to acquire those benefits. In this case, it is gaming the system and illegal (which is what an awful lot of people do).

If the primary intent is to marry because of the reason of love but BECAUSE the parties involved have distance between them, it is not possible for them to live together THEREFORE it is important for one party to acquire a green card to be able to live with their partner in a common place of domicile, then that places the purpose on love. The green card just facilitates that purpose. This is perfectly legal and this is what USCIS encourages.

Remember, America by virtue of it being a land of immigrants and with the importance of immigration to the development of a country loves immigrants, encourages it and puts in lots of resources to ensure it happens. It is however when it is done wrongfully with all the ill intentions that the system frowns upon. Hope this answers your question :-)
