Hello VJ Members

Im From Brazil and my fiance is an US Citizen! We are a same-sex couple.

So, We met in person in june 2010 and since then , my fiance has flown several times to Brazil to stay with me.

Back in August 2010, I tried to take a Tourist Visa, to go to the US to visit him and his family and friends, but it was denied under section 214b, due to lack of ties to Brazil, and they didnt stamp my passport, nothing, its blank on all visa pages.

Now, since gay marriage is allowed in the US under federal law, we are about to enter our k1 visa process, but im very concerned because, since we met online couple years before in person, and used to talk on the phone everyday, when he got here, he gave me a serious relationship ring.... we were not engaged then, but dating, getting romantically involved... so, when I tried to take the tourist visa, I said I was going to visit him, but listed him as a friend on the form.

Is this a misrepresentation??????????

Also, I dont remember the date he proposed me. He just wrote a letter in portuguese and readed it to me, asking if I wanted to marry him, and I said Yes!!! But I dont remember the date. And also, he didnt give me a ring when he proposed me, because we had our relationship rings already!

Im very concerned and confused.... I really love him, and he lived here with me for 3 months, but we ran out of money, so he had to go back to the US.... I cant even imagine leaving without him

Please, help me

What you did was not misrepresentation because you did list him as a friend. There is no category for 'boyfriend' so 'friend' is the correct term. You should not have any issues with your K-1 visa based solely on that particular. Just be honest and truthful during your interview(s) and dealing with the US consulate in your home country and you should be just fine.
