Hello! I'm new to this site and the K-1 process and thought that posting my worries might help! I am a US citizen petitioning for my long-time boyfriend to join me in the United States. The application has been straightforward so far, but there are three points where I'm worried we could see confusion or delays in our application process:

1. The beneficiary worked shortly after graduating from a US university (F-1 visa) on a temporary OPT work visa

- How do we bring this up in the application so they don't potentially see this extended stay in the US as a visa violation? The OPT work in question was actually unpaid work for a business-owning family member of mine who didn't really file any paperwork recording his employment (a last-minute work decision we had to make when his first OPT job offer was suddenly rescinded the day before the start date). Could this cause delays? I think the F-1 was valid up to 3 months after graduation, but the work period's end date was 5 months after graduation, so I worried it might look like a 2-3 month F-1 overstay with illegal work.

2. The US citizen (me) has a different name on birth certificate and passport

- For reasons unknown to me, my last name on my birth certificate and social security card have my mother's maiden name hyphenated with my father's last name. I've lived my entire life using only my father's last name. My passport uses only my father's last name. Should I fill out the K-1 application with the name exactly as shown on my birth certificate (with my mother's maiden name hyphenated into my own name) even if this isn't the name I normally use? Should I enter my "passport name" under "other known names"? Will I have trouble because I never legally changed my name to remove my mother's maiden name from my last name?

3. How do I get proof of long records of correspondence in today's digital age?

- We call each other daily using the free FaceTime feature on our Apple iOS devices. All text messages are free and sent via iMessage. We've never sent each other a single physical letter. How can we prove that we've been in contact? I may have some old Christmas or Birthday cards that say "I love you" on them, but they don't have dates or envelopes. I might be able to dig up some Valentine's Day receipts from Godiva chocolate shipments if that helps. What to do?

We're hoping to finish up our application and have it shipped out in two weeks, but I can't stop worrying about these issues! Responses are greatly appreciated! biggrin.png
