I have been in a long distance relationship for almost a year now and recently my girlfriend got her B-2 Visa to visit me here in the States. We have decided that we are right for each other and plan to get married. Obviously we don't want to do anything illegal or fraudulent that will hurt our relationship for years and years. Our plan is to get married here and then she will return to Peru while the CR1 process works its way through the system. I'm new to the process but understand that I'll apply with the I-130 form and then she will need to be physically present in Peru as well.

My question is, if we tie the knot here and mail off the paperwork to start the application, is there anything wrong with my wife to be staying here in the US on her B-2 visa until she is needed to by physically present in Peru? Or until her 6 months of legal stay is up, whichever happens first. In my research I have come across lots of discussion on trying to get into the US with a B-2 while the I-130 is pending, but what about leaving? Will it be viewed as a strike against us in the future that she stayed in the US on a tourist visa for 2-3 months after we got married?

No... Perfectly fine... Just make sure she does not overstay her visa... Very important. But yes, you can get married and file immediately while she finishes her visit.. No issues

11-30-09: GOT GREEN CARD in mail!!!!!!

Citizenship Process;

1/11/2013: Mailed N400 to Dallas Texas

3/11/2013: interview.. Approved

4/4/2013. : Oath! Now a U.S. citizen!
