Hello,

My pregnant girl friend is due the end of December and my divorce will be final mid December. My head is spinning wondering what course to take.

I have so many questions.

-How long does the fiancee Visa process take?

- Is a spousal Visa quicker?

-What needs to be done to register my child as a citizen?

- Is this a real benefit since no Visa will be required for the baby?

-Although I'd like to go back before she comes here,I can't afford to take numerous trips there- Is my presence required at any point? I think I'd rather go there at the end of the process to accompany her home.

I'm a bit overwhelmed and will appreciate any advice given,

Thanks,

Mike

Whew!

Firstly - congratulations on your upcoming birth!

Questions...

Fianceé visa process takes anything from 6 - 12 months at the moment. The spouse visa route is currently taking longer.

You obviously can't marry for the spouse visa until your divorce is finalised, nor can you begin the fianceé visa route until your divorce decree is in-hand.

You can find a comparison sheet for these two paths here: http://www.visajourney.com/content/compare

Step by step guides for each path can be found here: http://www.visajourney.com/content/guides

For USC children born abroad, there's information on this here: http://travel.state.gov/law/family_issues/birth/birth_593.html

You don't *need* to go back for anything, so long as you have met the meeting requirements for the I-129f, if you go down that route (which you obviously have, what with your impending child!).

You can find more regional specific advice and forum users over here (I even see a CRBA topic near the top in regards to registering your child abroad. Handy.): http://www.visajourney.com/forums/forum/129-philippines/
