I-130 filed in US pending...starting over with DCF?

I am the USC petitioner who filed the I-130 for my Indian husband back in April...I immediately left for India to wait with him until it leaves the USCIS step and heads to NVC...at that time I will return to the US to re-establish my job & domicile. However, the wait is now projected at 11+ months for this step. I've been in India for 7 months now. Can we start the process all over again and file a new I-130 DCF in New Delhi?

I know it means paying the fees over again, but this wait is ridiculous. All the money we had saved up is now being thrown away on our rent here...we initially thought it was only going to be a 6 month wait. I've heard DCF going from start to completely finished in 3 months. Accurate? I would certainly rather be planning our trip back to the US in 3 months rather than just crossing my fingers and hoping that things speed up and just MAYBE we can be in the US before the end of 2014!

DCF can be done in 3 months at the absolute fastest with much luck and an organised embassy, and an applicant who really keeps an eye on things.

It would be more realistic to give 5 months as an expectation to someone. Plus, AP can still happen with DCF. Times can't be guaranteed with immigration.

You can start all over if you want. You'd need to withdraw your existing I-130 by writing to the service centre it's at and you should check that you definitely qualify for DCF with your local embassy before doing that.

Thanks for the information! Gosh I really wish there were more things set in stone with this process. Its like a gamble no matter how you do things.

Think I'll contact the embassy first and see what they say before making any decisions.

Yeah, it's true. :( You're pretty far down your I-130 route already, so you may decide it's not worth the extra expense/paperwork to switch routes at this point.
