Need Advice

Hello VJ'ers. I have a question coming from a friend.

She had a crewman's visa, was inspected and has an admitted stamp on her passport. After her contract at the cruise ship (she got all her documents back, passport etc) she decided to stay here and did not go back to her home country. Her question is: is she considered a jumpship? Can she adjust her status based on marriage since she was inspected. She said that she was told only the ones that were not inspected are not allowed to adjust.

Please reply if you have any idea or know a similar situation.

This is what it says about crewmember visas:

How Do I Extend My Stay?

• Crewmember (D) visa holders are not able to apply to the U.S. Citizenship and Immigration Services (USCIS) to change status, adjust status, or extend their stay in the U.S., under immigration law. • You must depart the United States on or before the date indicated on your admission stamp or paper Form I-94, unless your request to extend your stay is approved by USCIS.
