Hi everybody. This is the first time I am posting here. I am living overseas in Argentina with my husband who is from Venezuela. I want to start the process for a spouse visa so we can live in the U.S. I have several concerns that I can't seem to find answers to.

We have tried but were not able to get a full copy of my husband's birth certificate. He had a last name change when he was 8 because his stepfather adopted him. We have a copy with the apostle's of his incomplete birth certificate that does not have the information from the adoption. I heard we could get his parents to sign an affidavit confirming his identity instead. Is that true and how would we do that? I am guessing a notary? His parents are currently living in Australia if that makes a difference.

Our other concern is that his passport has the incorrect date on it. He is currently an asylum seeker and as such cannot return to his home country. When he requested a new passport at the Embassy here they told him the only way to make the correction on his passport was to return to his country and they issued him another passport with the same mistake. The day and year are correct but the month is not. Is this going to cause us problems? I was hoping that if we could present his paperwork from his asylum case they might be forgiving of it.

Also, I have been wondering about our son's birth certificate. He was born in Argentina, but I also got him citizenship at the US Embassy. When they ask for his birth certificate to prove our marriage is valid, will they want the Argentine birth certificate or the US birth certificate or both?

Lastly, in this situation, will it be necessary to get an attorney? During my travels I have always done my own immigration paperwork, however, this case is more complex. I really don't know how or where to look for a good attorney. If anybody knows one or where to look, please let me know.

Sorry for so many questions, hoping somebody has some insight!
