Ok. My theft crime is NOT listed no asked on the i-129f. But I want to send them all the needed paper work. Just incase. I have nothing to hide. And feel it would be best to send it.

What exactly do they need???

how recent & grave is it and were you actually convicted for it?.. also.. are you (the one with the record) the petitioner or beneficiary?

I am the one with the record. I am the petitioner. The beneficiary has perfect record. And this was in 2005

well, im no lawyer so i can only suggest based on how i would act if i were in your shoes

i would mark that question as a NO seeing as I didnt commit any of the listed crimes. None of the option applies to you. However, I would enclose a letter explaining the circumstances of your record, I would include a police record too, and any other written proof that I am not a threat to my fiance or others and have no other records besides this one time. Perhaps any seminar or maybe letters from people you know? i wouldnt want them to think i was keeping anything by being technical that "i didnt apply to any of the options listed"

Although I dont think the theft record will impact your petition, it is always best to stay truthful, and I commend you for wanting to do so. I would still call USCIS and consult a lawyer about the best approach to your situation. i know others might disagree with my suggestion and say its better not to volunteer this info if not asked, i dont want it to bite me on the ### when im so far into the application process already.
