I have received all papers from my joint sponsor, however she doesn't own a passport. She sent me a copy of her birth certificate and driver's license, and social security card. She got married and divorced but kept her married name, so the name on her birth certificate is different than the name on application and all paperwork (drivers license, tax returns, etc.). Is that even an issue?

Most peoples names are different from their birth certificate because of marriage etc.. So as long as her current ID matches up with the names on the paperwork it will be fine. Good luck with your application :)

Most peoples names are different from their birth certificate because of marriage etc.. So as long as her current ID matches up with the names on the paperwork it will be fine. Good luck with your application smile.png

But the DL is not a proof of citizenship. Neither is the SS card. So it might not work if the names don't match the birth certificate that is the only proof of citizenship.

To the OP, what you could do is ask your joint sponsor to send you a copy of her marriage certificate. That is a proof of name change that is linking the Birth certificate to the name on the papers. Sending the copy of ID too is not a bad idea.

I would recommend not to send a copy of your joint-sponsor's security card along with a copy of a DL to the USCIS. Anyone can open a credit card on her name with this.

I let more experimented members double check this and correct me if I am wrong.

Thank you! I asked her for her marriage certificate. Hopefully she has it. She is no longer married but kept her married name. She lives in a different state so everything was scanned and printed by me from the scanned files. I hope that's ok rather than photocopies. She has sent me the I-864 by regular mail.

Oh well she looked and can't find her marriage certificate. She said it is a really bad memory for her (she got married at 17, they had two kids, that's why she kept the name -same as her kids-, but divorced, that was over 30 years ago). She doesn't have a passport either. Online I see that for other paperwork, a proof of a name change can be driver's license and social security card. Let's just hope that's enough!

She can just get another marriage certificate from the clerk of the county she married in.

If she doesn't mind, I would do that. If she doesn't want to, send the papers, if you get an RFE, then you'll ask her to go and ask for a marriage certificate. (or does she have a divorce certificate with her maiden name on it?)

An ID is proof of name change, but as there is no photo on the birth certificate they can't actually know that it is the same person. Anyway, try to get that marriage certificate, if you don't get it, worst thing that can happen is an RFE and you'll get the marriage certificate later.
