I am submitting my AOS application tommorow. In the K1 process back in australia I had to get an I-601 approved because I had a conviction. It was approved and I got my visa no worries.

Now that I am applying to adjust status, I had to mark yes on the I-485 Part 3 question 1 (B), having been arrested and all that before for the same thing I got the waiver for.

Will that waiver that I had approved still cover me or will they deny my application due to this.

I think that if they gave me a waiver to come here then I should be ok through the whole process.

Any idea's?

Have you kept copies of everything regarding the waiver? If so enclose those with your application. Might also pay to enclose a copy of your court records and your police certificate. Although they will probably retrieve this information when they do the namechecks etc but who knows what they actually get from the home country.

With the waiver being granted one would think everything would be ok to AOS but this is a different lot you are dealing with so perhaps a consultation with a immigration attorney would be in order just to answer any questions you might have.

I've seen many members of VJ who had to file waivers and had no problems with AOS.

So they didnt deny them when they marked the box on the I485 saying that they have been convicted?

I dont think that i will have a problem but you know how it is.

They will see my waiver on the system right?

Hi Nathan,

Just thought I would put a public reply in answer to your question to help any others that are going through the visa process with approved waivers, although I've already answered it in a personal e-mail sent to you today.

I didn't include any additional information on the waiver with the AOS package, I just ticked that box and left it at that. Liam4lisa adviced that I do this, and he was approved in LA after an interview. I was approved without an interview in 3 months from the AOS being submitted after having been transferred to the CSC...... and so the waiver should not effect your application whatsoever. I mean they will know that you had one, and that it was approved so why should it make any difference?, even though it's the DHS that you're dealing with now and not the immigration services in your home country.
