Hello, My wife went to her interview today and all well went except they told her she needs another joint sponsor because the orginal joint sponsor doesn't make enough. They kept her passport, and told her to have 2nd joint sponsor send in a affidavit of support and tax federal tax returns, they will review it and send in her visa DHL along with her passport. The thing is they accepted everything, that its mutual and everything except it came down to that point of joint sponsor and kept her passport instead of giving it back to her. Has anyone ever dealt with this before? Does this mean they denied her? I'm pretty lost because they wouldn't let me in the interview with her and she really couldn't explain in details what was said and needed except they need a 2nd joint sponsor.

It doesn't mean they denied her. It doesn't mean they've approved her either.

They've given her the opportunity to find a joint-sponsor who makes enough money and to get the correct documentation to them before they will approve her visa. She should have been told how to return the documentation she's missing to them (which it sounds like they did). So, get and send them a new I-864 with a sponsor that makes enough money, plus evidence.

The thing is the joint sponsor meets the poverty guidelines, yet they still need a 2nd joint sponsor... is that possible even if the joint sponsor meets the poverty guidelines they request another one, are they allowed to do that? or do they have to go based off the poverty guidelines??

Something is awry. If the first sponsor made enough, you would not be being asked for a new one. How much does the sponsor you already tried make and what evidence did you provide?

It sounds like the embassy believes the sponsor you wanted to use does not make enough money (or you didn't provide the correct evidence for them). They're asking for a new joint (as in, joint with you the petitioner - not joint with the first sponsor) sponsor who alone makes enough money.

My father (Joint Sponsor) is retired, didn't do his taxes for 2012 until I asked him to for the visa process. He went and did it and the tax lady didn't file right. So the papers he sent showed a quarter of what he makes. Well good thing my dad caught that and they filed an Amended tax return to fix the mistake. Waited for the Amended tax return to kick in and got the new Tax Transcript. My father mailed that to me, I gave it to my wife to give it to the interviewer and she did give it to them to show the proof of how much he makes. He makes 31000 dollars a year retired. The interviewer told her he doesn't make enough to support her my daughter and me. I'm in Egypt for the past 2 years studying so I really don't have a job. When I go back I'll start to work. That's pretty much about it. I don't know..

So you think the interviewer was reading the value for a household size of 4? Does your dad have anyone else in his household (spouse etc.)? I can see that his income wouldn't be enough at the 5 person household size, so wonder if that's what's going on?

My father is divorced. He lives alone. So weird..

Yeah, I'm not sure what to suggest. I think one of two things happened... either the interviewer just decided he didn't feel like that was sufficient, even when it wasn't under the level OR they didn't see the updated information you sent with the corrected tax data.

You could try submitting the same sponsor again, but double check all the forms and data you send in to make sure it definitely all adds up. Or, you can find a new sponsor.
