Hi Friends,

I am in a big confusion. I am planning to send my I-130 aand I-485 and I am also applying for EAD and ADP. My H1-B is approved for three years starting from October 2013. Now my confusion is should I go to embassy for H1-B stamping when I go to India this December, 2013 or not ?.

I really don't want to go through hassle of my Visa stamped when I already have ADP. SO what do you guys suggest?

I know even H1-B stamping is denied , ADP will be a backup but do you guys think I should even go for stamping. Also, when I get my EAD, I will be working on EAD and not on H1-b but I am thinking fo working on EAD after I come back from India.

Anyone has the same situation ? I would really appreciate your replies.

Hi. If you file soon, you'll have your GC well before Dec. To be safe file for I-131 so you're set. If approved, you won't need to get your H1b stamped. You can use Advance Parole document to re-enter the U.S.
