Hi all,

Been a LONG time since I've been on these boards. I've been a permanent resident now for 8 years and am in the process of applying for citizenship.

In reading through the 10 page N-400 form, there's only 1 question I'm having issues with that I'm hoping someone can help me with.

26. Have you ever been removed, exluded or deported from the United States

28. Have you ever applied for any kind of relief from removal, exclusion or deportation?

I want to say "no" to both of these, however I do remember a border incident from a long time ago (in 2000), where I was staying (extended visit visa) with my wife in Illinois and we had crossed into Canada to have her parents meet my parents for the day. Upon trying to re-enter the US, I was denied entry because the border agent thought I was trying to live there illegally. Since this was over 13 years ago, I'm unsure of the exact specifics. I do recall that my Dad hired an attorney to file some paperwork which eventually did allow me back in, but I'm unclear as to whether I was denied entry permanently at the time, and required the attorney paperwork to allow me to re-enter or if it was just an onsite denial of entry (possibly with an expiration date) where I could just try to enter again at another time. Either way, I do not have any paperwork for any of this any longer. I've contacted my ex-wife who said she will be looking to see if she has any paperwork but also has a fuzzy memory on this.

That said, I was able to gain permanent residency without issue...

I guess my question is, does any of this sound like an exclusion? It's not removal or deportation, but could it be exclusion? Would this still be in their system if an attorney reversed it? Part 10 doesn't require providing any paperwork or proof, it's just asking me a yes or no.

I'm really unsure how to answer this, or to find out what exactly happened at the border that day.

Any advice?

try youtube...they have some really helpful step by step tutorials on various forms..just look it up by form and perhaps you will find a answer that way. Good luck

Sept.12 2012- got Married to my best friend(Ms.Keyzz)

Nov.01 2012---- my wife went back home

Nov.08 2012---sent I-130

Nov.13 2012-- I-130 Case accepted and routed to U.SCIS National Benefits Center for processing

Nov.24 2012-Received R.F.E I-30

Nov.26 2012--Sent I-129f

Dec.24 2012--wife came back up for Christmas & new years

2013-01-04---I-130 approved

2013-02-04 ---send a letter to Cancel I-129f (can't remember date )& decided to file I-485

2013-04-15-sent I-485, I-130 approval hard copy and I-765 applications to lock box, Chicago, IL

2013-04-20- came back with a note stating the amount was wrong

2013-04-22- i-485 packet send to lock box, Chicago, IL ( the correct amount this time)

2013-04-25- email saying Case I-485 Case accepted

2013-04-29: Received both I-485 and I-765 NOA's hard copy in the mail and the Biometrics appointment letter

2013-05-21: Biometrics done & stamp on my I-797c

2013-05-31: check case on the USCIS web page & its said (your I-485 status is ready for Testing and Interview schedule ( NO EAD CARD)

2013-06-10-hard copy interview letter was mail( NO EAD CARD)

2013-06-12:case updated from testing & Interview schedule to Testing and Interview ( NO EAD CARD)

2013-06-15-Got hard copy A.O.S Interview letter in hand dancin5hr.gif( NO EAD CARD)

2013-07-10 - got a letter from NVC with a case number ( which we cancel from 04. feb. 2013)

2013-07-17- A.O.S approved on the spot ( less then 20 mins)

2013-07-18- Green Card was send out by usic

I don't think youtube will help, which is why I gave specific details as to my *specific* situation. Was hoping that maybe someone with intimate knowledge (such as a border agent, attorney or immigration officer) might be reading this and could help. Or someone in a similar situation.

That said, I just filed a Freedom of Information Act (FOIA) request with the Customs and Border Protection to acquire a complete history or my border crossings, with specifics to year 2000 in hopes to find out exactly what happened then.

If anyone has any other recommendations/ideas/suggestions, I'm all ears.

Thanks I also found that via google, but unfortunately it's not clear whether he answered yes or no. But he was approved and did get citizenship...

OK,I just contacted an immigration attorney here in Seattle and she was kind enough to help me.

26. Have you ever been removed, exluded or deported from the United States? I should answer YES to this question, because I was denied entry.
28. Have you ever applied for any kind of relief from removal, exclusion or deportation? I should answer NO to this question because while I was denied entry, I wasn't removed or deported and did not have to file papers with immigration for asylum or relief in that nature (in her words).
So I'm going to answer yes to #26, and no to #28 as well as attach to the back of Page 9, an addendum that explains in my own words what happened and how the issue was resolved and that there have been no other incidents of that nature since.
I think that should about do it.
