Hey there!

I'm a late January filer, and am hoping to hear back any time now about our package. I have a few questions that I hope someone can shed some light on!

Back when we first filed, I was unemployed for about 2 months-- and for the most recent employment state, we listed "unemployed". Over the past few months I've been doing training to learn how to market online, and have started producing an income from it. I registered a business last October (before filing), but I wasn't considered as "open for business" yet since I wasn't pursuing it yet since I was still employed at that point.

My questions are:

1 - Since I'm now making an income, does that jepordize our current package in any way since our most current status said I was unemployed? (All the way back in January)

2 - If my income is deposited directly into a Canadian account, and I'm paying taxes to the Canadian government (doing everything under my Canadian Business name), would I be allowed to continue doing business in the U.S since everything is online?

Are you the beneficiary? If so, it doesn't matter whether you're working or not. Are you pursuing K1? If so, once you get it, and get to the US, you will not be able to work AT ALL (even online for a Canadian company) until you get the greencard or the employment authorization doc.

Actually, that's not entirely true. You can't work in the U.S. -- that's for sure.

Working on the internet and doing everything through Canada, on the other hand, is not against the law, as far as I have heard. It might be best to ask, but since it is not being done in the U.S., I'm pretty sure it's perfectly fine.

I disagree. I needed a special visa to work as a journalist writing for Canadian publications, while in the U.S.

Yes, I'm the beneficiary, and we've applied for the K1 Visa.

I've called around, and it's hard to get a definite answer on this. It's part chartered accountant territory, and part US immigration lawyer territory. But I've yet to receive any closure haha!

It's very common for people to continue making business calls/emails when going on vacation in Florida or wherever, even when their business is registered elsewhere. I'm not sure, it's such a gray area.
