Hey all! So, my fiance' is in England, and I am in America, well we just got approved (for the I129F Petition for Fiance'). Its now being sent as a case to the NVC.

Well....I am a dual citizen of England (from my British father) and US( I was born in America) and I was living in England until I lost my job in December. He has been unemployed for over a year so we decided to make a move to America. I came back here in March thinking I would get a job again...I lived in England for 4 years...and I thought I could easily get another job here in America. Well...3 months later....and I am still looking for work. I am concerned now since I have to show proof of employment for his visa. I am a teacher and I am looking for work for the next school year but I cant apply for jobs till next month. And to top it off, he just recieved news that he may get his old job back in England, and its a professional permanent job.

Hmmm..decisions decisions! Do I stay here and worry about finding a job to support him and have him come here and look for work, or do I go back to England and have him work and I try to find work? His parents paid for the petition and did give his money for living here, but I dont want that to be a burden. I was thinking we could eventually be married in England and then apply for a different visa right? Would that be an easier visa to obtain (if thats even possible?)

Thoughts....advice....ideas?!! smile.png

You can apply for a CR1 spouse visa later of you want. It is like starting over and not particularly easier or harder than what you are doing now. If you were resident in the UK at the time, you could apply directly to the USCIS office in London, rather than to USCIS in the US. That could shave a few months off the time. You would still have to sponsor him financially with a job in the US or find a joint sponsor who has enough income...just like for the K1 you are doing now.

You can stall your K1 while you see who gets a job and make your decision before continuing or abandoning. It's not that easy to find work in the US either. He would be several months before he could accept a job on a K1 visa because he would have to apply for a greencard and work authorization after the marriage.

Thats what we have been thinking. I am thinking of having a cut off date and then decide if I should stay or go back. At least in England I would get dole money and some assistance. Its been so hard here living off nothing and putting a burden on my parents. And I was also thinking he would need a car here as well. Fingers crossed this job of his is good enough and then I can head back. What a crazy roller coaster this has been....as is life! :) At least I can go between England and the US as I please.
