Hi, I've been looking around trying to figure out what route I should take for my wife. Either DCF or k-3? Another route? In any case my is/at from Spain. We got married in Spain little over 1 1/2 ago. I never filed any paperwork as I was military stationed overseas in Spain and then went to Italy. My tour was cut a year short unexpectedly and so never properly prepared. Plus I never planned on returning to the states to live until a few years from now.

She came to the states for the first time 2 months ago visiting my parents for the first time as well as the states. Well she loved my parents but never really was fond of the U.S. Since the overseas jobs I wanted didn't come through, we decided about 3 weeks ago that I'll go ahead and work here for a few years before trying to go to Spain. I want to get her back over asap as I miss my wife.

She doesn't know any/or little english. Nor she understands the politics or whats needed for the process. I can prepare it all for what I can do, but the process might get confusing for her in Spain. In all honesty I would like to do it all in the states with her if possible.

She lives in southern Spain, far from Madrid or Barcelona, so her traveling there alone is pretty much out the question. What are our best options?

Thanks.

K3 and/or CR1 are about your only options. And she'll have to travel to the consulate for an interview, there's no way around that.

Check the website for the consulate to find out of DCF is an option, but then you'll have to travel over there to file the petition.

She can't just come to the States and stay, you're already married so she's not eligible. She'll have to get either of those visas before she can live here. And it'll take a few months.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card
