Income Question -- Self employed + Child Support

My 2011 tax return is pretty low due to write-offs, etc.

My 2012 tax return is over the 100% poverty line but under the 125%. However, with child support it is over the 125%. How confident should I be this will work for the K1 and/or AOS sponsorship?

A co-sponsor is not available. I am self-sufficient and my business is making steady income. I am not sure if the 2013 return will be over 125% poverty line though it looks likely I will hit it.

We filed in late Jan so we're not expecting answers til Aug or so. I loathe the idea of having him go to the interview and get rejected, but it looks like the child support should make it work. I do have proof (court ordered and paid through the state due to garnishment of the ex -- alimony is also garnished).

1/31/13 - 129F Sent
2/7/13 - NOA1
** transferred with 2nd group from VSC to TSC in late June
7/9/13 - NOA2 (5 months)
8/16/13 - Shipped from TSC
9/11/13 - Packet 3
9/19/13 - Forms sent in.
9/24/13 - Medical Done
9/27/13 - CEAC Status Update
10/02/13 - DS-260 mailed in
10/15/13 - CEAC Status Update (DoS couldn't say what triggered it, did say no interview assigned, but all docs are in)
10/23/13 - Embassy email states they do not have our documents. Poor Steven does 160 again.
10/23/13 - DoS says our case is still "processing" and not "qualified" (interview ready) and to do newest forms.
11/05/13 - CEAC Update. DoS says case is "eligible for interview" and we're waiting on next interview date.
11/08/13 - Another call to DoS (Chris is a nice guy!) and no interview scheduled yet.
11/12/13 - Another call to DoS and no interview scheduled yet.
11/13/13 - Email from Embassy to Steven informing him that his interview is TOMORROW.
Hurray for Patron Saint of Immigrants - Mother Cabrini's Feast Day!
11/14/13 - INTERVIEW --- APPROVED!!!!!
11/19 & 11/20 - CEAC date update, but still at "Ready".
11/21 - CEAC Creation Date & Notice Changed.
11/22 - CEAC AP
11/25 - CEAC ISSUED -- yay!!
11/27 - DoS Shipment Notice (email) in AM. Pickup ready email sent in PM.
11/28 - Steven picks up docs from Bridgend - Happy Thanksgiving!
12/15/13 - Arrival in US. POE: JFK. (Heathrow - JKF - Richmond, VA by evening)
Getting Married in January with small ceremony.

my husband K1 visa got approved using child support as an income using form I-134. as long that u provide the evidence such as court order, statements or bank statement stated your childsupport deposit.

but for some reason now that we are adjusting his status. IO not honoring my child support income. (maybe he/she's a new hire...that's why he/she didn't know that's part of income too..not sure why?? we went to infopass..it just waste of time)

anyhow i just recently start a part time job to boost my income and also, ask my employer to give me a raise. so i submitted that to my RFE and write them a letter why their not honoring my child support income even it was stated in the I-864 page 5 instruction that it could be counted....

as of may 2,2013, my status online is still under RFE response review. so i'm still waiting for the outcome!!!

I'm sorry to hear it isn't working for your AOS. That's my main concern is the K1 will go through but AOS will not.

it actually did work for other applicant/Vjer's member w/no problem nor question ask..i guess it depend who's the CO. just like when we went to the infopass. the one assisting us she just a beginner....she still in training lol she had someone next to her that teach her how to use their computer system and it's pretty obvious she doesn't know what to do lol

The longer it takes to happen the more you'll appreciate it when it does!
