Hiya,

So currently my partner and I are unsure of whether we will live in the UK or the US after this summer, pending which of us can get a job. I'm doing research into the US side of things and trying to figure out how I'm going to fulfill the I-864 (given that we are both students right now). My understanding is that my assets are valued at 1/3 the income requirement and hers at 1/5. However, I cannot find any mention of a time requirement for holding those assets? It is my understanding that paystubs need to go back for 6 months when using income to meet the threshold, but is this also the case for assets? Or can we just show that between the two of us, and taking into consideration the 1/3 and 1/5 valuations, that we have assets over the 125% line?

They normally will not count the foreign spouses assets or income... And the assets needed is 5x the 125% poverty level regardless of his or hers. As far as I know, you do not have to show having these assets for a specific period of time.

They normally will not count the foreign spouses assets or income... And the assets needed is 5x the 125% poverty level regardless of his or hers. As far as I know, you do not have to show having these assets for a specific period of time.

It's 3 times the difference between income and assets for the USC, but in practice they want to see MORE than 3 times. A primary residence is considered a poor asset to count because you cannot liquidate it for cash to live on quickly or for its full value.

Ok.. I was under the impression they want 5x for everyone.. I know when we went through the Italy embassy they were REALLY sticklers for finances... Sorry for any error...

They may like to see 5 times if you are relying ONLY on assets, but the instructions say 3 times. It doesn't matter in the end; if the immigration official believes you do not qualify unless you're wearing a purple scarf over your left shoulder, then that is what they will go with. I know that income of the intending immigrant does not count unless they can prove it will continue in the US, and foreign assets are a problem unless they can be quickly liquidated when needed to provide money for living expenses.

True dat! And even if the income of the intending immigrant will continue (which was our situation as he was working for the company and was being transferred to USA) they did not count it... Which is not to say all offices will be the same way... But better to be over prepared than under.

Well, all my assets are in stock and all of hers will be cash savings so liquidation won't be a problem. However, it is interesting to hear that even getting above that line with assets might fail. Thank you for your responses and acknowledging that there doesn't seem to be an amount of time for assets held.

Am I also correct in finding that there really isn't any other way to get my spouse over to the US, with the ability to work, short of a company sponsoring her?
