Hi

I have been working in US for several years on TN status. I just changed my TN in February when I switched job and I am getting married in April to my fiancé who is a US citizen. We plan to to visit parents overseas after the wedding and come back to US and I'll enter with my TN. But after I read several articles and posts, it looks like it's not recommended, is that right? What should I do then? Do I keep using TN or should I apply for Green Card?

What are my options?

Do not leave the US under any circumstances. I have been in the US for 9 years under TN status (recently married) and was contemplating the idea of doing a destination wedding. The day you get married the TN status becomes questionable due to your intent to immigrate. This can cause you to be denied entry at the border. Once married you should file for AOS(I-485), I-130 petition for alien relative/spouse, I-131, and I-765 EAD. You will no longer be able to renew your TN status "Legally". I'm not saying its impossible but legally you would be commiting visa fraud.

02/28/2013 [Day 0] - Mailed AOS package (I-130, I-131, I-485, I-765, I-693, I-864) to Chicago Lockbox via USPS Priority Mail. Accidently sent it with signature confirmation. Was processed within 24 hrs.

03/01/2013 [Day 1] - AOS Package delivered to USCIS Chicago at 1:30pm

03/07/2013 [Day 8] - Received 4 NOA1 notifications via E-mail around 11:45 pm

03/07/2013 [Day 8] - Checks cashed

03/11/2013 [Day 12] - Received hard copies of NOAs for I-130, I-131, I-485 and I-765

03/14/2013 [Day 15] - Received Biometrics Appointment Letter - Scheduled for 04/05

03/15/2013 [Day 16] - Successful early biometrics walk-in

03/27/2013 [Day 28] - Received (I-485) notification via E-mail. Testing and Interview

04/26/2013 [Day 58] - Service request made on I-485 (30 days past notice)

05/03/2013 [Day 65] - Received EAD Card production notification via E-mail.

05/07/2013 [Day 69] - Received EAD Card production notification via E-mail. (2nd notice)

05/08/2013 [Day 70] - EAD Card mailed. (3rd notice)

05/08/2013 [Day 70] - EAD Card tracking information provided. (4th notice)

05/10/2013 [Day 72] - EAD/AP Card received.

05/11/2013 [Day73] - Received EAD Card delivery confirmation via E-mail.

05/11/2013 [Day73] - Received letter in mail regarding service request on I-485. Interview will be scheduled soon.

05/22/2013 [Day84] - Received email for I-485 interview June 26th.

05/25/2013 [Day87] - Received interview notice in the mail.

06/26/2013 [Day 119] - Interview for I-485. Not approved on the spot.

07/05/2013 [Day 128] - I-485 Card/Documentation Production Ordered

07/16/2013 [Day 139] - 2 Year Conditional Green Card Delivered
