10 minutes after i post this topic on VJ http://www.visajourney.com/forums/topic/399189-ir-2-cr-2-and-aos-questions/ i open our email and found this email from US Embassy Manila.

this is my email to us embassy manila last august 7, 2012 (before sending new k3/i-130- application)

Sent: Wednesday, August 08, 2012 2:36 PM

To: Manila IV Correspondence Unit

Subject: K3 Visa we applied last 2007

We applied K3 last 2007 and was interviewed after 8 months, they want us to submit affidavit of support but by that time our income is less than the poverty level so we just agree to live together in the Philippines, Now we plan again to go live in US as I missed my family and my disability getting worse. Is our case really terminated? that was over 4 years ago or is there any way we can continue it?

*we got automated reply says: We forwarded your communication to the processing team concerned for appropriate action. We will notify the applicant once further information is available. from us embassy.

On September, we believed that our application is terminated my husband file a new application k3/i-130 and got NOA1 last september 2012. Just today i received an email from us embassy that confused me!

Dear Ms. *****

Records indicate that on September 10, 2012, we sent the applicant a letter on how to proceed with the case.

Attached is the scanned copy of our letter for your reference.

We will resume processing the case once we receive the requested documents.

This is in reference to your K3 nonimmigrant visa petition still pending in this office. Your K3 petition is still open, so you can proceed with it. We also find a record of an IR1 petition, EAC**********, which was approved on 21Dec2007, which you can pursue as an alternative, although we do not yet have the documents from NVC, and your petitioner will have to request that they be sent to us.

In either case, we will require documents, you should submit the documentation to the US Embassy via any branch of 2GO courier service (Attn: Immigrant Visa Branch with a copy of this letter and the 2GO Courier Submission Letter (see attached).

(we never get that hard copy postal mail because we moved 3 years ago to our present address)

Confusion:

in my understanding, the letter means that we can continue our 5years old application? why it says we got approved on 21Dec2007, where in fact that date is when my husband send our first i-130 application in US.

what we're going to do now? send the documents requested to the embassy using our old Case Number? What about our new application which is still pending in Lee's Summit?

Please need guidance here!!!

IR 2 VISA PETITION
2013-02-11: I-130 Sent
2013-04-03: I-130 NOA2 APPROVED in 51 days from our NOA date

2013-06-07: Both IR1/IR2 case AOS/IV BILL shows Paid

2013-06-17: Schedule interview online

2013-06-19: USEM Case Received
2013-06-24: Received email from USEM Case Received
2013-07-11: Medical Exam Day-no tst need to go back on the ff day

2013-07-15: Medical Exam Day- tst result (-) immunization

2013-07-18: Interview Day

2013-xx-xx: Visa Received
2013-09-10: POE Dallas, Texas

(USCIS/NVC letters took an average of 50 calendar days to arrive in the Philippines so we don't rely on letters, thanks God for internet and VJ)
