I am the petitioner, and my wife is the beneficiary. I have couple of doubts on I-864 question number 21. Below are those questions:

Question 21:

a) Enter the number you entered on 1ine 10: This would be 1 for me, since I am only sponsoring my wife.

c)if you are currently married, enter 1 for your spouse: My question is since I've already entered 1 in a), if I put 1 again in c), i will be double counting my wife with respect to household size. Isn't that true? On the other hand, I am married to her, so putting 0 would be a little misleading!! Please guide me.

e) If you have any other dependents, enter the number here: I am guessing this number should match to the number of dependents I am claiming on my tax return. Is that correct?

Will appreciate any help.

That is a confusing question! I filed the I-864EZ since I only sponsored my spouse and didn't have a cosigner (if this applies to you, file the I-864EZ instead). In looking at what I put for this question, it asked:

"Your household size - Do not count anyone twice.

a. Yourself and the person you're sponsoring on this form

b. Your spouse

c. Your dependent children under age 21"

There's a 'd' and 'e' option, but I didn't bother to type it as it did not apply. Anyway, I only put 2 for 'a' and left 'b' blank where it asked for spouse. I think since this is an AOS for any relative, it asks you to mark your spouse for household size if the person you're sponsoring is NOT your spouse. Since the person I sponsored IS my spouse, I did not count him twice, so our household size is 2 (just he and I, no dependents).

Hope this helps! Don't mark your spouse twice :)

Thank you for replying back. I have couple of follow up questions. Pardon me if these questions seem juvenile.

1) I am a little bit confused on the overall process. I read the guide here, and some timelines but still need some clarify. My I-130 just got approved and got the NOA2 in mail. I guess the next step is another letter from NVC that they have received my file, and will provide a case and contact number. But what is the next immediate step after that? From the timelines I gather that I will receive something called DS3032/I-864 Bill. Then I have to pay that, and then both me and my spouse will get separate packages of forms to fill out?! I will highly appreciate some clarification on steps after NVC letter.

2) What is the difference between I-864 and I-864EZ, and does USCIS tell us which one do I need to fill?

I will also appreciate some responses from people who have actually completed I-864, who can answer my original question of how should I count my spouse who is the beneficiary of this application, in terms of household size.

This is an EXCELLENT guide. This will answer you Q1

You may use I-864EZ if ALL of the following conditions apply:

1) You are the petitioner

2) The relative you are sponsoring is the only person listed on I-130 (i.e. if your wife is the only beneficiary)

3) The income you are using to qualify is entirely based on your salary reported in W-2 (i.e. if you are an employee with W-2 and the income in it is enough for you to qualify as the lone sponsor for your relative)

To add, an I-864 is valid for someone who's eligible for 864EZ too.
