Hello

My wife became a US citizen a few months back and filed a petition to bring her parents over. I was am the only sponsor, and make well over the 125% that the 864P requests. We sent in the documentation, and it sent it back stating I needed to fill out an 864A and that my wife obviously had to fill out her own i864. She doesn't work, we aren't looking for anyone else to co-sponsor, so do I have to fill out an I864? Or do I just need to fill out her I864 for each of her parents and send them back? We have also done our taxes together for the past 6 years, do I need to provide separate tax documentation for each of us? Any help would be appreciated, trying to avoid expensive lawyer fees for this process. Anything else I need to provide besides my job letter/taxes/etc?

thank you

The I-864a is the contract between your wife (the sponsor) and you the (co-sponsor/household member). You are considered a co-sponsor because it is your wife petitioning for her parents. So yes she fills out I-864 and you fill out I-864a. It does not matter if she has income or not she has to fill out the form. What ever tax returns you have are fine, and it will show one of the requirements for the I-864a and that is that you must show that you are related or have claimed that person (sponsor) on your tax returns. Although I would still send a copy of the the marriage license to show how you are related as well. Look over the instructions for the I-864a can't remember all of the other proof that needs to be sent as well, or if you need to send separate forms for each parent or if you can put them both on one. Best of luck to you.
