Hi all,

Just to recap - Based in Ireland, Filing via NVC in the USA as DCF no longer available.

Anyway, I've been away for a while sorting out tax returns for my USC wife. I posted the 1040 forms and 2555-EZ forms to the IRS address in Texas, for the years she has been in Ireland, as suggested on this site and I am waiting for for the tax transcripts to come back so I can attach them to her I-864. But I am now unsure what happens next as I have been told 2 things and as they are quite different. My head is MELTED!! :crying:

1: I spoke to the NVC who said that I should submit the DS-230 with all my documents to them. They also said I should send my wife's I-864 form and documents, and as I require a joint sponsor, my joint sponsors I-864 form and documents.

2: On the other hand, I have recently spoken to an immigration lawyer in Ireland who "does this sort of thing alot" who said I just send part 1 of my DS-230 form and personal documents to the NVC and take DS-230 part 2 and the I-864 forms with me to the Embassy when I get my interview.

On a side note, I have not received a DS-2001 in any envelopes I have received from the NVC, and after reading a bit about said form on this site it appears this is how you let the visa unit know you are ready for an interview. Do I download this form or will it be sent out once the NVC process my forms? (whichever forms I end up sending from the above options)

I hope someone out there can help as it seems every time we get a bit of momentum, something pops up OR we get a bit of duff info that makes us doubt what we are doing.

Anyway, Fingers crossed this all makes sense.

I think that you, and maybe the immigration lawyer, are getting confused between the different processess for the spouse visa and fiancé visa. With the spouse visa, the documentation, including the DS230 and the AOS, is all collected by NVC. Once they have everything they need they will assign you an interview date and forward all the paperwork to the Embassy. With the fiancé visa, the application just passes through NVC briefly, is assigned a case number and is then forwarded to the Embassy. So you do not need to complete the DS-2001- NVC will tell you when you are ready.

You will need to take copies of the paperwork with you to the interview in case anything has gone astray but it should all be in your file.

Thanks, :thumbs: this sounds better. I will post all the stuff off today then and see how we go on. fingers crossed I can get it all sorted pretty soon. The only thing my Wife is concerned of is if we send in the wrong things or miss something out of a packet at this stage and they make us start all over again. as I doubt we could afford to go through it all again.

No, they will just issue an RFE. They might even just tell you to take it to the interview - it depends what it is. Just make sure you send the original documents to NVC. They will be returned at the interview.
