I was just thinking.....if the waiver is denied for my fiance, what other options do we have besides me moving to Mexico? Is there a certain amount of time that has to go by and then you can apply again or is the waiver denial the end of the road?

Oh sweetie - you do need to get some sleep (I saw your other post). For me, Ambien (prescription) is the answer!

If the waiver is denied (it won't be if you are well prepared and have written a strong hardship letter and provided sufficient evidence), you would reapply when the ban is over (either 3 years or 10 years depending on how long he was out of status in the US) or you would appeal. Don't even think about that - put your energy toward a strong letter!!!

KK how are you communicating with your fiance? Are you calling the hotel or does he have a cell? I heard that cell phones are banned in the consulate and am worried about mine taking his.

That's correct no cell phones allowed so he cannot take it. My fiance's cell phone doesn't work in CDJ and with the November 4 changes in how cell phones work in Mexico, it has been impossible to get through on his cell even when he's home. He emailed me yesterday from the hotel when he got back but he also has a phone card to call. I called him at the hotel yesterday after I got his email, but he will probably use the card to call me at the end of the day when he is finished.

Emma - glad you are safe and sound - enjoy your time with your fiance (is in in the 'burbs? what city?)

Lucy, if your fiance has a Telcel he can text message you too, that's what me and my fiance do all the time, and the new dialing rules don't apply to text messaging.

I am not sure about the dialing rules. What exactly is that? Are text messaging long distance for you? He does have Telcel but I wasn't aware of the dialing rules. It seems like I am always the one calling him.

Timeline

Well, starting Nov.4th, whenever you dial a cell phone number from the US you have to dial 011-52-1+area code+number. This is to change the way cell phone owners are charged, with this new method "el que llama paga"= the one who initiates the call gets billed for all the charges. This means that if you call your fiance to his cell phone you get billed for his minutes too.

This doesn't apply for text messaging though, you use the same number (without the "1") you used before to call him on his cell phone. We do get charged for "international" text messages, but it's nowhere near as expensive as calling the US using our mexican cell phones.

I have Verizon and Leo has movistar - we can text message. However with this new phone change - I still can't call him but he can call me. Hopefully it will get worked out soon. He also has one of my Verizon phone's with US number that he uses. Verizon North America plan. No extra charges for calling each other. Just goes against plan. However with this Nov. 4th change. All american phones in Mexico aren't working.

E & K - so glad you arrived safely in states.

I recieved an email today from Senators office stating they have sent an inquiry into CDJ.

I hope it helps. I've been in this K1 fiasco for a long time.

Amigas tengo una pregunta:

I've been reading several posts on this forum about affidavit of supports (I-134) and the supporting evidence for them. I know CDJ doesn't require this form, but I've been reading so many posts asking about Tax transcripts, tax returns, W2's, etc. that I'm now wondering if we should take them to CDJ.

The I-134 states that they are required if the sponsor is self-employed, my fiance is not self employed and has already requested a letter from his employer with the information required. His income from his current employment is well above the required level; however, he's in the process of moving to another job with a much better pay than his curent one. I will probably not have more than one- if even that-paystub for my interview from his new job, since he still doesn't know when he will start on it- he just accepted the job offer- and this new job is of course not listed on any of the applications we have submitted so far.

So my question is: should I even mention the new job? I was thinking to just take the latest paychecks that he has from his current job, the bank letters, a recent house valuation from earlier this year, AND his tax information from the last 2 years, do you think this is a good idea?

There is no such thing as sleep on this wild journey...hehe If I post my hardship letter, would you give me some pointers? I want to make sure it's a solid approval :)
