Hi All

here is my story

Priority date july 2004, EB3

Substitute Labor applied from AMSOL INC ,Casper Wyoming INC

after long waiting received an Interview for I-485

Update on my Interview for today ,

IO had taken my Oath and my spouse

IO asked to us to signed on the paper that we have no obligation to go head the interview without our Attorney

then asked us about the name, DOB, address and then started saying about my case

She said that my previous employer(AMSOL INC , Casper, Wyoming ) has involved in a fraudulent activities like Virtual Office exists but no real company and applied lot of substitute Labors(Iam one in that list) and asked lot of questions like 13 questions like how did I came to know this company , did I went there physically, did I ever worked over that location, how did my interview with this company came , how did they offered me , when is the start date, end date , how do I report them or meet them often, did I take any training in that location?

She printed out my answers in a paper and asked my signed and took witness from some officer in the same office.

She told that since my employer applied a labor from casper wyoming office , where there is no real office exists, she suggested 2 options for me

1. USCIS is still investigating the Fradulant petition on the Casper Wyoming office and would let me know their decision once clear utill my case would be pending and she is going to send her decision on this Interview that my case has to be denial to NSC center (Nebraska) , for that she gave an option untill I wait for the final decision, I can apply for the new labor and port my priority date to this new labor but have to wait for again 485 becomes current.

2.I have a choice to withdraw this I 485 and can apply for the new H1 with all new labor processing (which I guess I would have to leave this country , since Iam no longer on H1 and on EAD from last 4 years)

I choosed Option 1, to wait for the final decision and in the meanwhile would apply for the new labor requesting porting, in case denial comes I would go for MTR(challenging that I have no idea about my company involved in these fraud activities and Iam innocent, since I Worked without any breaking laws and I paid my Taxes every year)

last, I didnt understand why she took our I-94's originals from passports and also Birth Certificates and my Current Employer Employment Letter. If she has to send her decision on my Interview results as Denial to NSC , why did she need all these documents to be kept with her.

Finally, we got a copy of Interview Results as " USCIS FORM I-485, Application to Register Permanent Residence or Adjust Status is being held for review. No Additional information is neccessary from you at this time"

any idea what does this means statement.
