After 2.5 years of LPR (LPR 10/24/2007), I was laid off, My dad was seriously ill, so I left the US with an approved Travel Document. I traveled in &out and was employed by an American company there. I now returned to the US to file N400 (5 years date 10/24/2012).

My time away from the US: (One was 8 months)

27-Jan-08 31-Mar-08 2 months, 4 days(64 days)

25-Aug-10 10-Feb-11 4 months, 1 week, 5 days(133 days)

18-Feb-11 8-Nov-11 8 months, 3 weeks(263 days)*

18-Nov-11 29-Mar-12 4 months, 1 week, 4 days(132 days)

6-Apr-12 20-May-12 1 month, 2 weeks(44 days)

1. How should I list the address when I was away from the US? A US address or an overseas one?

2. Should I include my employment overseas with an american company (no W2)? Heard that it could hurt the case but I sealing it is not good either. Thanks

What is this Travel Document you speak of? Did you file for the N-470 ?

You may qualify based on this rule -

The new rule is that when an applicant’s employer is a publicly held corporation that is incorporated in the USA and trades its stock exclusively on USA stock markets, the employer is deemed an “American firm or corporation.”

Perhaps more experienced VJ'ers can shed light on your issue.

Travel document: I-131 valid from June 2010-June 2012. The reason for the travel document is for my dad illness situation and I do have a doctor letter to support that.

I am now in the US and resigned from the US company in Thailand. That company is solely traded in the US stock market. Not sure if it is still ok to file N470 or too late now.

What is this Travel Document you speak of? Did you file for the N-470 ?

N-470 has to be filed before or after you commence your employment with the US Company overseas. I don't think it can be filed now.

I-131 is the Re-Entry permit which protects your Green Card Status. However, you have broken residency by staying out of US for more than 6 months. Also, your other absences, though less than 6 months, are of longer duration and will raise a red flag during the interview.

Yours is a iffy case. If you don't mind risking $680, then go ahead and file the N400 and hope your IO is sympathetic to your reasons.

Otherwise, you can apply 4 years + 1 day after your return from the longer stay outside the US which would be 9-Nov-2015.
