I and my husband are filling concurrently I-130, I-485 and I-765. I have a question about the I-765

1. I am currently F-1 student with a valid SSN from DHS to work on-campus, never work off-campus so am I considered as renewed EAD or initial EAD?

2. What category of my eligibility that I will fall into? ©(9)- Adjustment Applicant?

3. Is there a fee for I-765 since I read the exception for fee waiver and it not includes the ©(9) category?

Thank you

11/16/2012: Sent the pack to NBC

No Biggee, we all have done this by mistake.

You can send an email to the mods, or "self-report" by using the report button in lower left corner (it gets the mods attention)

The mods will just move it so you dont have to start over with a redundant thread

1. Initial EAD. Note: EAD is a diff doc. from SSN

2. category ( c ) ( 9 ) is correct

3. You wont have to pay for I-765 cos you filling the I-485 as well. Read more here http://1.usa.gov/yrs7xw or read below

"If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, and you paid the I-485 application fee required, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 together with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of a Form I-485.

If you are filing for an extension of your Employment Authorization and your Form I-485, Application for Permanent Residence, was filed before July 30, 2007, then you must pay the $380 filing fee."
