New member. First post. K1 Visa. USC Male applicant from Alaska. Canadian female beneficiary from British Columbia + one 16 yr old daughter. Tried to fill in timeline so other members can review and help. We have been waiting 226 days, no NOA2. Are using immi lawyer (if we knew then what we know now ... we would NOT have hired lawyer).

At five months we requested "service request". Immediate RFE. USCIS requested "certificate" of divorce from USC, as "final order" not sufficient. USC applicant went to court house to obtain and lawyer sent in nov 29. Emailed CSC Dec13 to follow up and confirm receipt - immediate auto response, otherwise ignored. USC visited Canada in Dec and at 30 days we called USCIS to follow up. Tier 1 - script. Tier 2 - no update available. Called lawyer for update. Useless.

Suggestions for next step is the reason for this post. Have other Canadians experienced this ? Does USCIS blackball applications if you follow up ?

I would say its time to start contacting your congress person that is affiliated with immigration. Have them peek into the case, this can often get USCIS to get a move on.

You should not be blackballed for looking into your own case, often people find that calling and talking/requesting information helps them. Lots of people say if they did not keep after their own case that USCIS would have shelved it and left it sitting there.

If you are trying to call USCIS and speak to an operator follow the prompts for an " address change " then simply ask whats going on with the case.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Although I am processing a CR-1 I had a similar experience while processing my own paperwork. I contacted both sentators and our congressman to have them assist with our NOA2 by inquiring with USCIS.

I guess it helped as we had an approval within 14 days of contacting our representatives!!

Although I am processing a CR-1 I had a similar experience while processing my own paperwork. I contacted both sentators and our congressman to have them assist with our NOA2 by inquiring with USCIS.

I guess it helped as we had an approval within 14 days of contacting our representatives!!

May I ask, by "contacting" did you mean phone, email, fax, or in person ? I was leaning towards email as then we can include the "release" permission form, along with a written request and NOA1 doc. Thanks for the good wishes - we can use all the happy thoughts !

Well, I went to each of their web pages to complete the form that they requested and added some supplementary information/summary of our information to ensure that the major case details were consistantly expressed. I then faxed each representative and followed up within a few days. I did receive letters from 2 of the 3.

I hope they had a hand in helping to get my NOA2 faster... If not, it didn't hurt my case at USCIS at all!

Today we received the following via email:

Application Type: I129F , PETITION FOR FIANCE(E)

Your Case Status: Request for Evidence Response Review

On January 19, 2012, we received your response to our request for evidence. This case is being processed at our CALIFORNIA SERVICE CENTER location.

... You should expect to receive a written decision or written update within 60 days of the date we received your response ...

I must say I am relieved that our file is not "lost", but dismayed that the document we sent in on Nov29 is just now being "received" on Jan 19 and they are giving themselves another S I X T Y days to review one additional piece of paper. They felt that a "final order of divorce" was not sufficient and they requested "certificate" of divorce.

Does anyone have experience with this ? Do they typically need or use this much more time ? thanks, P
