Hello Everyone and Happy New Year!

This topic is not for me but its for a friend that waiting on K1 approval. her papers processed last year October 2011 for a K1 visa and after a few weeks her fiance received Case Number. Right now their case is pending. Her worried about is--her fiance have Government assistance program which is helping him temporarily for some other things that he cannot afford here in USA. last year before he applied the k1 visa he lost his job so he need to find a way to survive here so he apply for assistance. Now he is back on track and have his job he seems ok now. BUT THEIR WORRIES more if the government assistance will make a big deal on the INS if they find out about it. He is afraid that the K1 visa might be denied because of it.

I was hoping to help them answer the question and hope to get answer from here..

I am assuming the assistance you're talking about is unemployment benefit. If this is the case, it won't have any bearing in the approval of the application.

The most important thing is getting through the first phase of getting an approval for the K-1 petition, which will take a few months. By then, the petitioner

would be employed now for a few months and can prove job stability and exceeds the poverty guideline for annual salary. The USEM will be mainly concerned

with the petitioner's current income and the petitioner's ability to support the beneficiary once in the US.

yes...He got his job back before he applied his petition but his issue is he was still in government assistance now. He said that his income is around 35+ I was wondering about the income poverty level of USEM if that will going to effect. hopefully not. He filed last year October 2011 and their case still pending..guess they have to cross their finger.Thank you so much for the reply It help so much.
