filing I-485 for F1 wife

Hi everyone,

My wife is a F1 student and we have been married for 4.5 years. Her I-130 was approved back in April 2011. I became US citizen last Tuesday(Dec 20th 2011). Now I want to file AOS for her. From what I know I need to fill out I-485, I693, I-864, I-765,please advise if i am missing anything. I have couple of questions:

1.In form I-485 what should be the answer for the question on part 2 "Application type" ..."I am applying for PR status because?"

2. If my wife doesn't go to college at all next semester which starts 3rd week of Jan(and she hasn't registered for classes) will it jeopardize her application?

3. With form I-864 I read that they also require IRS tax return transcript and my wife has worked outside of college using her SSN(which is obviously not considered legal). These tax returns were filed joint. will this create a problem?

Congratulation on your citizenship!

1. You should file based on marriage of USC.

2. If she doesn't go do collage it won't do anything to her application

3. Your income taxes are positive because you are showing that marriage is bonafide! (don't forget that your household income needs to be at least 125% of poverty guideline)

I believe that in I485 is questing regarding employment without permission. i will advise you to tell the truth and do not hide anything! Even if she worked illegally in USA it should not harm her case. You should contact immigration attorney ad talk to her(or him) regarding this case!

02/12/2015 RFE I-131 asking if I was or I'm in removal proceedings

03/03/2015 Respond for I-131 RFE sent to VSC

04/02/2015 RFE for Bona Fide Marriage, proof of shared residents and request for more evidence regarding Abuse received

04/20/2015 I-765 and I-131 APPROVED.

06/25/2015 Respond to I-360 RFE sent to VSC

07/14/2015 I-360 application APPROVED!!!

ICE

04/29/2011 Went for appointment with ICE officer and got processed
06/01/2011 Turn my passport in and started to report to BI twice a month in BI office, ones a month via phone and once a month they come to my home
01/05/2012 Still don't have court date!
02/02/2012 Terminated removal proceedings.

Thank you Macbook. Hoping everything will go fine, waiting for my tax return transcripts and employment letter to arrive before I send in the app.
