This isn't for me but for someone I know.

His wife is only 17 of age but he's 20. He's an american citizen and she's a mexican national. They're already legally married in Mexico. Which should cross over into the U.S.

Ok, well the problem is she was caught by the Border Patrol at the age of 16, they weren't married at the time, but just about too though and she did something stupid. They did the regular procedure, took her fingerprints and her photos and sent her back to Mexico, but didn't state any penalties.

Well, they're planning to fix the papers and file for her I-130 forms. But the cause of concern is her prior offense. I'm just wondering, is he wasting his money or can it be done still to get her greencard?

Honestly it seems complicated. First she made an attempt to get in USA but was failed, this can be a ban for her. For around 10 years if this is the case.

Plus next thing is that to prove that she and he have a bonafide marriage relationship? It depends up to many factors, how long they stayed together, how long they knew each other, so many factors.

Their relation is pretty real, been together for 2 years. I told them to apply for a K-1 visa but since her age, thought it would be disallowed in the US. The biggest problem is the prior offense, and I honestly don't think they give minors a slap on the wrist? lol
