Received green card with error, applying in replacement

Hi everyone,

Haven't posted much but this forum has been an invaluable resource!

I received my green card in the mail in September but didn't notice there was an error (only one extra letter) on it until I went to renew my SSN card and the lady there pointed it out to me.

So I prepared the paperwork to replace the green card (had to do it on paper since they will only accept replacement applications via mail, not electronically). Filled out the I-90 and all.

Now, I have 2 questions.

1. It cost me $450 to get the green card and I'd hate to have to pay the $365 again just because of one mistake. I realize it costs nothing to do this since it was a USCIS error (I triple checked everything on my application to make sure it was correct)

but do they still need a check mailed to them?

2. With the I-90 do I also mail them the green card with the error or just a copy?

Please let me know if I'm missing something or I need to send something else in addition to the I-90.

If you spelled your name and all the other details correctly for your green card paperwork, and it was USCIS who caused the typo, they pay for the replacement card.

But if you spelled your details incorrectly in the paperwork, then it would have been your fault, and in that case you'd pay.

But if you spelled your details incorrectly in the paperwork, then it would have been your fault, and in that case you'd pay.

yes, I understand that. But my question was whether or not I need to send in the check with the application in the mail?

Was it your mistake? Then yes, you need to send a check. If it was their mistake, then no, you don't.

It was their mistake. In the application I wrote my name down correctly. Everything else - my driver's license, my SSN card, passport everything has my correct name. This was sent to me with the mistake.

So, I don't have to send in a check then. Do I need to include the green card with the mistake in the envelope?

Yes. Please read I-90 instructions, page 2, D - My exisiting card has incorrect data because of USCIS error.

Who's error is it? Yours or theirs?

If it's yours, you can file for I-90 and send the check for $365 (without biometrics) $ 450 (with biometrics) or wait for ROC (if the error doesn't bother you) and file then. If it's theirs, you can file for I-90 without the check or wait for ROC (if the error doesn't bother you) and file then. You have to mail back the original GC, no copies.

Yes, you have to mail back the original GC, no copies.

I filed for I-90 due to an USCIS error and so I'm answering your questions from my own experience.
