Hi,

I came as a student in 2007, dropped out of school in Sept 2009 and got married in Dec 2010. My wife miscarried in 2008. During this entire period, I didn't work(no SS) and mostly received limited funding from doing software and web design work(so, no tax returns). Due to limited finance, we weren't able to start the AOS process. We plan to start it this week and I have a few questions.

My father-in-law is going to sponsor us. He got divorced in August 2011 ( he was married for 30 years ).

1. I-864 part 5. He's single now and his past 3 tax returns show he's married. If I fill out 0 where it asks for a spouse, should I send proof of divorce? If I do so, with the fact that he just got divorced, is it going to affect my AOS?

2. Is it a red flag that I haven't worked during all this time?

I haven't ever had any problems with the law.

Thanks for you help.

1. He is your sponsor, not your spouse how come it affects your AOS with his divorce.

2. Working without EAD is against the law already. You might have to answer what you did after your drop-out at the interview. Because your are out of status for more than 2 years.
