In question 9. I have previously submitted affidavit(s) of support for the following person(s). My question is, since I have previously submitted one for my ex fiancee I assume I should put yes but do I need to explain that she did go back to her country within 90 days and that we didn`t get married? And on question 10. I have submitted a visa petition(s) to USCIS on behalf of the following person(s). Should I also include the petition for my ex? Thanks!

yes.

when did you petition your ex?

Does'nt matter when and where in the US. The Original Petition is a Matter of Record. Sounds like a K-1 and never got married and overstayed. This will require a Wavior.

A Petition for your Ex-wife. ??? Sure, bring her along too. Where did that come from ?

After reading again. Your post indicates you had a previous K-1 with the same person. Now you are re-filing again with that same person. (I Think) So its not an Overstay Issue but you decided not to Marry back then and want to try again. Yes, you should list it that there was a previous engagement to this very same person if I read it right. If this is true then just list it. No Law is Violated.

You confused me when you used the word "Ex" ...

Not the same person, that`s why I said "EX" fiancee :) and yes you`re right... no overstay

I see. But I caution you. There are limits as to how many times you can Petition Overseas with a K-1 Visa. I think it 2 times. In addition, there is short period of time between each Petition.

It doesn't matter where but sure it matters when...

See item #2 page 2 if the waiver applies to you.

Looks like it's still a little over 2 yrs since your previous application was approved.
