Hello,

Currently in the U.S. travelling (under visa waiver) and met a great girl who is now my wife!

my question is i only have a couple of weeks left on my esta, should i return home to the uk and tie up loose ends and apply for IR-1/CR-1 from there or would i be better off staying and applying for AOS?

You should be able to AOS here with no problems at all based on what you said about meeting her here. But be aware that once you start the AOS filing, you CANNOT leave the country until it is done or you receive an AP--it will usually take 3 - 4 months to get the AP and 4 -5 to complete the AOS.

Slightly off topic from the Original post but how do they know you have over stayed these days with ETSA? i know a part of the old green form was handed back in when you left the US but i cant figure out how they know you've actually left now ? just curious
