This is RK, USC petitioner for my fiancee, Inday--hopefully very, very soon to schedule visa interview. A bit of background and two or three questions I hope those of you who might be experienced/knowledgable on this topic might be able to help with:

Background: In short, the birth certificate copy which Inday had in her personal records contained a clerical error and the whole certificate was severely faded. The clerical error was simply a typo in her last name: using a wrong vowel for one of the letters in her last name. Furthermore, this birth certificate copy--issued by NSO on security paper--was so faded it was almost impossible to read/discern her name or any other particulars. Many years ago, apparently Inday successfully petitioned via affidavit for correction of clerical error. Inday tells me she still has the affidavit showing correction.

Question 1: Would this (extremely faded certificate with clerical error but with affidavit) be satisfactory at the interview or no??

More Backround: Quite awhile ago, I was concerned about the faded contents of the birth certificate and knew Inday would likely need other birth certificate copies for various reasons, even after a visa interview at the embassy. Thus, quite awhile I encouraged Inday to request NSO clear copies with correction to clerical error. So Inday--after undergoing quite a hassle with misinformative and uncooperative administrative officials in her province--eventually got the information and help she needed and submitted all the required documents.

Inday submitted all these required documents two months ago and was told to expect her corrected birth certificate with clear copies to be sent to her in two to three months. Now, two months later and with us able to schedule her visa interview even sooner than we had originally anticipated, Inday still has not received corrected and clear copies nor any word at all. Inday and I are now quite nervous about not having clear, corrected certificate in time for the embassy interview.

Question 2: Is there a way to expedite the processing of her birth certificate request or check on progress?

Question 3: If Inday does not receive corrected and clear copies before visa interview, will this present a problem and if so, do you have any suggestions??

Q1: Probably a problem. Sorry

Q2: You can try but the question is how. Sorry

Q3: Minimum time = 3-4 months and usually 6 months. Delay interview or go ahead with interview and plan for the worst...a White Slip. Sorry

on Q1: The consul will ask for certified true copy of the birth certificate in question.

Q2: No other way to expedite the process unless they know someone from NSO who can send her BC back and forth the NSO main office to the local registrar. to check the progress, she can go to any NSO where she can get a copy of her BC, if the BC has an annotation on it regarding the correction, then your problem is solved, meaning the NSO already updated the said correction in their system. she can use that BC during the interview at the US Embassy.

Q3: My advice is the advice above. that's what I did anyway and that's what my VJ friends did when their BC appears to be "blurry" which is always the case if you're born in the PI.

Tell her to bring the Green Copy of his Birth certificate( the original one not the Authenticated).

Or she can go to a public lawyer and get her an AFFIDAVIT of EXPLANATION..explaining the situation.

ANother thing i can suggest is there is a way( I did that before) to expedite she just have to pay extra and let them know she needs it real soon.

Another suggestion while waiting for the Birth Certificate..to get another copy from a travel agency that process passport..they sure have connections inside the NSO office and can get it quicker for extra charge( i did that with my 2nd child too).

ALl this worked for me.

My suggestion is get a certified true copy from the local registrar where her birth was registered. I got one from Manila, shows a clearer version of the data in my NSO birth certificate.

HappyBlessedMe (<--good name, BTW :yes: ). Yes, you have helped enormously. Yes, the dates on Inday's Birth Certificate are also "blurred"/faded; pretty much everything is. Didn't know could ask for copy at travel agency; thank you for sharing your personal experience about this. Thank you also for the suggestion of affidavit of explanation. I have only vaguely before heard of such but when you mentioned I started looking up information on this and am understanding how this could well be useful. No problem, I am the same way before the interview. I want to make sure that I covered everything that they might ask of me. No problem, I am the same way before the interview. I want to make sure that I covered everything that they might ask of me. I noticed that most of the entries in my BC is unreadable, maybe because the machine that NSO used is so old, that it can't print properly anymore. I went to my local registrar just to make sure I have something to present in case the Consul decided "I can't read it, therefore, I'll give you a 221g" bleh! So that' s what I did.

"Bleh!" certainly sums it all up well! :lol: Thank you again for giving not only suggestions but more hope. As we all know, this roller-coaster visa journey seems to have enough ups-and-downs and loop-de-loops to make one's stomach spin & do flip-flops. BTW, I see by your timeline your visa was approved a little over a month ago. Very maany congratulations to you and thank you for inspiring me and encouraging me with yet another success story! -RK

YOu are very welcome. That;s what we are here for. I was once in ur situation and when i started my k1 i did not know vj yet. But when i started doing I -130 for my kids that's when VJ had played a great part on our visa journey.

June 25, 2012 - hardcopy AOS, EAD, AP "NOA1"s (I-797C) received
June 29, 2012 - appointment letter for biometrics received (appointment: mid-July)
July 14, 2012 - Biometrics appointment: complete
July 18, 2012 - Case transferred to California Service Center notice received
August 27, 2012 - Combo EAD & AP card received

April 25, 2012 - Permanent Resident card (conditional) received; Yahoo!!! (no interview)

REMOVAL OF CONDITONS
March 28, 2015 - I-751 filed; sent via USPS priority mail, signature upon delivery requested
