Hi,

Ok my husband has been working full time for 1 and half years, the previous 2 years he wasn't working full time.

His new job now is $15 an hour and will be far above the poverty line. It is a temp to hire job- but they have told him they are going to hire him. Although he has been with this job for 1 month.

Do I need a co sponsor because the previous two years tax's wont show above the poverty line? But this year's will.

I was told on here- that they go on predicted future earnings of the job he has right now?

Any advise would be appreciated since the NVC stage is coming up.

(im not sure we can get a co-sponsor)

I suggest co-sponsor. Not only because he has not been working full time but even more importantly because this is currently a temp job. Since 2010 tax return will not show above poverty line, you need to present at least how sustainable his current job is. It is not until he is officially hired on a permanent position. Get a co-sponsor.

So if we cant get one- we should still file to the NVC with what he has right now and a letter from employer- saying he is expected to be hired full time? or would we have to wait... 6 months and drag the NVC process out?

So, if we cant get a co-sponsor...Would a letter from an employer saying he is expected to be hired in 6 months be substantial??

Thanks- I didnt think about this. He was employed with a company until recently for 6 months- but they went out of business and this new job was a great opportunity when hired- it was too good to turn down!

Thankyou, we will do this but also try to get a co-sponsor.

One more question he hasnt submitted tax returns for 2008 or 2009. Would he have to do this to satisfy this question?:

''I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year''

He only needs to submit the most recent tax return, although he needs to list on the form the amounts shown on the most recent three.

His projected year income is more important than his past year income which is more important than his most recent tax return which is more important than his income prior to that. So if the first three things are all ok then it really does not matter if he did not earn much in 2008 and 2009.

It may be useful to include his last pay stub from his old employer as well as his most recent pay stub. If the pay stubs don't show that it is a temporary job I might not bother with the letter unless they ask for additional evidence.
