Is he in Mexico now and has the ban from the deportation run its course?? If either answer is no, there is more work to do.

And if he has EVER returned to the US without inspection since the deportation, you have big problems. You need to spell out ALL the details--when he entered (every time), how long he was here , the exact date of the deportation, how long is he banned due to the deportation and as well as any bans from any other immigration findings--then, and only then can we help analyze your case.

he came here first in 1996 and was deported in 1998 then came back to the US in 1999. In Dec. 2005 he had to leave to mexico but was only there for 1 month then came back it was then that was caugt , he said immigration only kept him for couple hours then released him. but he is not sure how long he was banned from US

im not expert but i have read some stories here if he has enter to the us more than once illegally thats problem and he can be banned for 3 years,10, or forever. Im guessing you havent get your interview yet, so he might get denied for that and if it does they might let you go for a weiver wich its a good thing altough it cost more money. Maybe someone can answer better to your question.

P.s Yoy should read some reviews from the consulate theres some similar stories to yours goodluck :)

Yikes !!!

You need to go to this site where they focus on your situation--you will get far more help there than here. Bless you and good luck. You are more than likely going to need an I-601 waiver, and it might not come easily because of the multiple entries--get over to the other site TONIGHT so you can get the ball rolling.
