Hello Everyone! :help:

I hope someone could help enlighten me on my confusion. I came across with an old topic posted here on the use of Presumptive Dead Spouse as termination of previous marriage in the Philippines. According to the posts, the US Consulate in Manila now viewed it as fraud or with suspicious. My Fiance filed our K-1 Petition only the other month after coming several times to meet me personally. I met him online early 2008, but I was quite hesitant before to get into next level since I haven't met him yet in person. Though we can say we do really have a good, special, and mutual communication and understanding within more than 2 years. Our personal meetings in 2010 proved that we are really in love with each other and so we begun with our K-1 journey hoping we can be together and happy for a lifetime.

I thought there was no issue about my previous marriage because even then before I met my Fiance online in 2008 I already have a copy of Court Ruling Declaring my Spouse as Presumptively Dead issued by the Court in 2007. My then Marriage Contract in NSO Security Paper had already been annotated of the court declaration. And this is the document we submitted to our petition as evidence that I am now free to marry or my previous marriage was terminated since 2007.

" What are the main reasons a K-1 visa is denied?

K-1 applications are subject to the same review standards as immigrant visa applications. The main reasons for visa refusal are: lacking documentation; need to review or verify evidence; lack of a petitionable relationship; misrepresentation of the facts; medical concerns; criminal grounds and potential public charge.

A common basis for refusal is a prior marriage for the beneficiary or the petitioner that has not been legally terminated. There is no divorce in the Philippines. A consular officer will only accept a death certificate or a court ruling of annulment or of presumptive death as evidence that a Filipino marriage has been terminated. An American may terminate a Filipino marriage through a U.S. divorce.

If is now viewed as FRAUD, then how could I file for an Annulment since I can't even locate my ex that was why I filed for the presumption of death and approved by court. Consequently, I don't think I can still file for an annulment if he is already declared dead by the court. Please enlighten me on this case as I am terribly confuse. We are still waiting for our NOA2 to come hopefully.

I don't know where to contact my ex since he left us several years back with no support. Earlier years I tried contacting his own families but to no avail. That's why I had to move on with my life and kids, thank God we are all doing great even without any support as I do have a great decent job. God has been good to me all the times.
