I applied for a K-1 visa for my fiance in 2006 (Korea). He needed an I-601 Waiver of Inadmissibility. I appied in 2007 and It was granted in 2009. But since he still did not apply for the visa the application has expired and now I must file the I-129F again. I have to go there too because although we met in person 3 times we have not seen in each other in person within the last 2 years.

Will we need to get a new I-601 waiver too? It was because of his police report that we needed one. Assuming there are no new police problems, is that waiver still good? The embassy said in an e-mail to me that it was:

"Thank you for your e-mail inquiry. A waiver does not expire, so you may use the same waiver for a new visa application. However, please note that your K-1 visa petition has expired. All K petitions are set to expire within 1 year from the last action date of the subject case. Since you have not took action within 1 year from the waiver approval date, your petition is no longer valid for a K visa. Should your fiancée apply for a K-1 visa, you should file a new I-129F for your fiancee’s K-1 visa application.

We hope this information is of assistance."
