Ok I'm gonna need some professional opinions here, my case is a little bit complicated.

1. my step dad filed two seperate i130s for me and my mom, hers got approved and mine got denied because of the marriage took place when i was 19.

2. so my mom's case moved on, got transferred to NVC and she is now in the last phase before the interview.

3. i called up NVC about my mom's case and you know what they told me, they told me my case is still good despite the I130 denial because I'm the derivate beneficiary on my mom's I130 case. I remember put my name on my mom's I130 where it says "list all the cilldren you have". And now they want me to pay my IV fee and file a seperate visa application for me in order to have my case going, and they said I'm going to be interviewed together with my mom at the same time. They also told me my age was not a issue or something like that, like I was under 21 when my current date became available or watever.

Now, is this really gonna work? I mean, i dont wanna pay another $404 for something unreal. And if it does work that way, well, can i elect to be interviewed in the united states, do i file I-485 now?

thanks guys
