My fiance from Australia and I have applied for our K-1. He has visited me off and on using VWP. We've received our NOA1 and are patiently waiting. He was here from July 7 - Oct 5, and left on time. He's never overstayed or been denied entry before. He left, and now I am facing a crisis situation in which we are debating whether he might try to come back again. We have a lawyer, we've already filed the k1, he already left once... I am sick and would like for him to come back again. I know, I know, it depends who you get at the border. I just don't want to jeopardize our entire lives. My question is:

1) If we can provide documentation showing he will only be here temporarily (like letters from my doctor, things showing his ties down there) will that help?

2) Can they give him an expedited removal on the VWP? or will he just be denied entry? Is there a difference? He only wants to come back for another month or so.

If they deny him entry, will it ruin our K1?

Can't answer about this.

He only wants to come back for another month or so.

If they deny him entry, will it ruin our K1? No, not at all. He wouldn't have done anything wrong.

thank you for your response. I was worried that if for some reason they don't let him in, he wouldn't be eligible to come back on his k1.
