Sorry for the multiple posts here... the questions just keep cropping up!

Sent the I-129F on March 15. Entered the US on Aug 31 as a visitor (land entry, no passport stamp, despite asking for one). While I've been here my fiance received NOA2 on September 23, 2010. We're waiting for Packet 3 (to be sent to my Canadian address, where my parents are there to receive the package).

I intend to return home by November 21 at the latest, and would like to return to the US to visit my fiance for the month of December. I know that I'll need lots of proof of ties in Canada in order to hope to get in.

I'm a retired professional and am a self employed photographer, making a letter from my employer rather impossible (though I intend to show my booking calendar with proof of work back home). I have sufficient funds in my bank account and statements to show that. I can book myself a return ticket to show intent to return.

Should I anticipate trouble at the border trying to come into the US? What else can I do to show ties to home, and an intent to follow the law?

I would suggest bringing something that proves permanent residence (at least for the foreseeable future) in Canada - like a mortgage statement, rent payment, etc in addition to bank statements and a return ticket (an absolute must!). Other VJers have advised bringing your NOAs to prove that you are following the rules and that this really is just a visit.

It sounds like you didn't have any trouble crossing the border for your most recent visit, so just do the same thing next time! Some border guards will ask a lot of questions, others will just wave you through, but for your own peace of mind, having proof in hand is a good idea.

I totally understand your concerns as I've had the same. My fiancé and I started this process in January and I filed packet 3 in June. I finally was able to schedule my interview in September (for October 20th). I visited the US on numerous occasions since January, and never had to show proof of anything. Customs officers on occasions asked a few questions, but I never doubted that they would let me cross the border. I never carried anything specific with me until a month ago, when an officer advised me that I should be careful since I was close to spending 50% of my time in the US. I now travel with my interview confirmation letter.

I'm by no means trying to say that you don't need to be concerned, as we obviously have to be mindful of laws and regulations. I would definitely carry evidence of filing with me just to be on the safe side. And be honest! Always the best policy.

Good luck to you!
